PRICE AND DESCRIPTION OF GOODS

Prices become effective from the date of issue of the sellers current Price List or date of quotation and are based on the cost of commodities ruling at the time of issue. The seller reserves the right to change them without notice as a consequence of any increase in costs and to change a price ruling at the date of delivery. Cost prices are exclusive of VAT. Suggested retail prices shown are inclusive of VAT. The seller undertakes to maintain the designs illustrated in catalogues, leaflets and other literature or as supplied to the buyer as a sample but reserves the right to make changes to goods supplied without notice provided such changes do not reduce the value of the goods supplied.

CARRIAGE AND MINIMUM ORDER

Bullyland Figurines:

  • Minimum carriage paid order £300 excluding Vat
  • Orders under £300 excluding Vat, carriage of £15.00 ex Vat will be added
  • Minimum order £250.00 ex Vat

Piping Bags:

  • Minimum order £500.00 ex Vat, carriage paid

Ribbons:

  • Minimum carriage paid order £200.00 Ex Vat
  • Orders under £200.00 excluding Vat, carriage of £15.00 ex Vat will be added
  • Minimum order £150.00 ex Vat

Cake Collars:

DEFINITION OF GOODS AND EXTENT OF LIABILITY

“Own goods” means goods that have been designed and/or     manufactured or assembled by the seller. “Bought in goods” means goods purchased by the seller for onward sale to its customers without addition or modification (except for packaging and/or packing).    

  • Own goods ordered for association with cakes or an alternative specified purpose (but not for unintended uses) are sold with the benefit of all provisions of Sales of Goods Act 1979 save that the seller’s liability in respect of any claim in respect of them shall be limited to a monetary sum equating to the sale price (excluding VAT) of such of them as may be alleged to be defective, late delivered or otherwise subject to complaint.
  • Bought in goods are sold with no condition of warranty express or implied by statute or otherwise as to their merchantability or fitness for any particular use.

 

DELIVERY OF GOODS

Delivery dates are estimates only and time of delivery is not the essence of the contract. The seller will endeavor to deliver the goods by the stated delivery date but may suspend or delay delivery and will not be liable for any loss whatsoever in the event of late delivery or non-delivery of goods or any installment outstanding. The buyer shall not be entitled to refuse to accept late delivery or treat late delivery as a breach of contract.

CLAIMS

Claims for damage or shortage must be made in writing 7 days after receipt of goods to comply with carriers limit of responsibility. Claims for non-delivery must be made in writing within 14 days of date of invoice. The seller cannot accept responsibility for breakage which is discovered after goods have left the buyer’s premises of have been altered or used in any way by the buyer and claims so made cannot be entertained. The seller reserves the right to refuse a claim when goods are dispatched to the buyer’s customers under the buyer’s own labels as sender; proof of dispatch to be accepted as proof of delivery.

RETURNS

The seller will not accept any edible good products returned by the buyer.

The seller will not accept any items discontinued from its range returned by the buyer. In addition, the seller will not accept any seasonal items returned by the buyer.

No goods are sold on “sale or return” basis and no returns will be accepted arising from an error on the part of the buyer. The seller reserves the right to levy an appropriate handling charge (£20.00 or 10% of the value of goods, whichever is the greater plus carriage at cost) on goods returned once the seller has agreed with the buyer that the goods may be returned. Goods will not be accepted for return unless such goods are in a condition suitable for re-sale by the seller. Any goods returned without prior agreement with the seller will be held by the seller entirely at the risk of the buyer and will be due payment within the normal terms.

PAYMENT TERMS

All invoices are due for settlement within 15 days following date of invoice. The seller reserves the right to charge interest on overdue accounts at 7% over the Bank Base Rate prevailing for the period that the debt is overdue

Cash against pro-forma invoice may apply until satisfactory references have been obtained by the seller

RESERVATION OF TITLE

The seller at all times reserves the legal and beneficial ownership in goods sold by them until payment has been made by the buyer in full of all sums owing by the buyer to the seller. The buyer shall keep all the goods the property of the seller in such a manner that they can readily be identified as such and the buyer hereby authorizes the seller to enter onto the buyer’s premises to recover any goods which are not paid for in accordance with these conditions.

WARNING

Many products are unsuitable as play items for children under 3 years due to small or sharp parts.

SHIPMENTS/PARCELS

Insurance and freight costs and/of postal charges to buyer’s account

LOCAL REGULATIONS

The buyer undertakes to ensure that the goods comply with all local regulations imposed by the country of destination.

PACKING

Goods are packed free of charge in a manner suitable for the method of dispatch.

METHODS OF PAYMENT

  • Cash against documents through first class Bank in buyer’s country.
  • As agreed in writing with the seller
  • Cash against pro-forma invoice.
